1. Scope
Please read the following Terms and Conditions carefully. They apply to www.tintin.com and cover all use of the Site. By accessing, surfing on and registering with the Site you fully accept the Terms and Conditions. The Terms and Conditions are accessible from the Site at all times. You may print and retain a copy of the Terms and Conditions. In ticking the relevant box at the bottom of the Registration Form or by surfing the Site, you confirm that you have read the Terms and Conditions and that you fully accept them. The Terms and Conditions are available in English.

2. Definitions
The meanings below cover the use of terminology throughout the Terms and Conditions, unless indicated otherwise:
“Sign Up Form”: the web page displaying the registration form in which personal information and other information is entered.
Certain parts of www.tintin.com (for example Tintin TV, the monthly competition, Collectors’ Zone, etc.) are accessible by:
- completing the Sign Up Form;
- reading through and accepting the present Terms and Conditions;
- entering an E-mail address and choosing a Username and Password.
“Password”: a personal and exclusive Password chosen when registering with www.tintin.com.
“Newsletter”: the Newsletter published by www.tintin.com that is sent on a regular basis to all Users who have filled in the Sign Up Form. Users may opt out of subscription to the Newsletter by ticking the opt-out box on the form or by clicking the STOP button;
“Personal Information”: the Personal Information concerning the User, provided during the registration process;
“E-mail address”: the e-mail address that the User provides when registering or logging in to www.tintin.com.
“Username”: the surname or the first name that the User provides when registering or logging in to www.tintin.com.
“User”: the person who registers with www.tintin.com by filling in the Sign Up Form and by clicking on the SIGN UP button after having read and agreed with the present Terms and Conditions.
“Site”: The Internet Website www.tintin.com.

3. Obligatory information provided by the User
By registering on the Site and in completing the Sign Up Form, the User agrees carefully to provide correct, precise and complete personal information to www.tintin.com. If there are any changes to this personal information the User will update the details held by www.tintin.com to ensure that they remain correct, complete and up-to-date. The User agrees not to use another person’s identity or to use a false name. If some of the information provided by the User is false or imprecise, www.tintin.com reserves the right to suspend or cancel access to restricted areas of the Site.

4. Modification and suspension
4.1. www.tintin.com may, at any time and for any period of time, modify or suspend part of www.tintin.com without incurring any liability.

4.2. Unless for reasons of urgent work, www.tintin.com will notify the User of any planned maintenance work or of any alteration or suspension of the Site. www.tintin.com will try to carry out all such maintenance work outside of normal working hours (from 9 a.m. to 6 p.m., from Monday to Friday) and will try to ensure minimum disruption for the User.

5. Personal Information
5.1. Personal Information is collection via the Site and is treated by www.tintin.com in the strictest confidence and in accordance with the Belgian law of 8 December 1992 (as modified by the law of 11 December 1998) concerning the protection of privacy in relation with the handling of personal information, and the French law of 6 January relative to information, files and rights. Moulinsart is responsible for the handling of Personal Information. Statements in this regard have been made to the Belgian and French authorities under the reference numbers 01637320 and 823170 respectively.

5.2. www.tintin.com uses Personal Information for administrative purposes. The User nevertheless accepts that www.tintin.com may, for marketing purposes, (i) share or communicate Personal Information with partner France Télévisions or (ii) send Newsletters or other messages by electronic mail, unless the Newsletter opt-out box has been ticked on the Sign Up form, or the STOP button has been clicked, in which case Newsletters will not be sent.

5.3. The User has the right to consult, modify, correct or delete their Personal Information on the Site by sending an e-mail to info@tintin.com. Personal Information will be retained for the duration of the Site.

5.4. For more information regarding privacy, the User is invited to consult the public register updated by the authorities for the protection of privacy.

5.5. In no case may www.tintin.com be held responsible for any direct, indirect or accidental damage resulting from the erroneous or abusive use of Personal Information by partner France Télévisions.

5.6. The User or Visitor accepts cookies that allow, during future visits and connections to the Site, them to be easily and quickly identifiable and their sessions to be recorded etc. In the event that the User or Visitor deactivates these cookies then www.tintin.com cannot be held responsible for any inconvenience, errors or functionality issues that may result.

6. The User’s account, Password and security
6.1. When registering, the User must provide an E-mail address and a Password that remain private and exclusive to the User. The User’s e-mail address and Password grant access to certain areas of the Site. When logging in to restricted areas of the Site the User must provide an E-mail address and a Password.

6.2. The User accepts that the provision or their E-mail address and Password are the means by which to prove their identity.

6.3. The User is fully responsible for the confidentiality of their E-mail address and Password and www.tintin.com may not in any case be held responsible for any use of their E-mail address and Password by third parties. The User is authorized to allow family members living at the same address the use of their account.

6.4. The User must immediately inform www.tintin.com by e-mail to info@tintin.com of (i) any unauthorized use of their E-mail address and Password and (ii) any resulting security breaches.

6.5. In the case of forgetting their Password, the User may go on the Site and request to receive it by clicking on “forgot your password?”

7. Intellectual Property Rights

7.1. The Site, its content as well as all other material including the presentation of the Site (graphics, characters, structure, mapping, etc.), titles, photographs, videos, animation, software, music, sounds, banners, advertisements, logos, etc., hereafter referred to as “Original Material”, are protected by copyright and associated laws. All drawings, texts and characters, objects and symbols reproduced on the Site are, unless otherwise indicated, taken from the work of Hergé© or the work of Moulinsart and remain the property of Moulinsart.

7.2. In virtue of the aforementioned laws it is strictly forbidden without the prior authorization of Moulinsart to (i) reproduce, (ii) adapt, (iii) use, (iv) translate and (v) make available to the public any Original Material. As a consequence the User may not (i) scan, adapt, digitalize or modify, by himself or by a third party, the Original Material (ii) reproduce, by himself or by a third party, the Original Material, in whole or in part, on any type of support (notably books, newspapers, prospectus, advertising leaflets, postcards, CD ROMs or any other electronic supports) in any format (ordinary, deluxe, mass-market, soft back, hardback, in any dimension, in limited edition or not, on disk, cassette, etc.) or (iii) broadcast or authorize the broadcast to the public the Original Material including via audiovisual broadcast or via Internet, etc., without being liable for prosecution for infringement under laws and international conventions.

8. Responsibility
8.1. www.tintin.com cannot guarantee (i) that the Site will satisfy the specific expectations and demands of the User and (ii) that the Site will continue uninterrupted or free from errors.

8.2. The User or Visitor will not hold www.tintin.com to obligation regarding the performance of the Site.

8.3. In no case may www.tintin.com be held responsible for any direct, indirect or accidental damage resulting from the incorrect use of the Site, from a misunderstanding of the Internet and/or the use of the Internet, or from any downloads or all other software or any connection to periphery hardware.

8.4. The Site may contain links or hyperlinks to other sites (“Linked Sites”). The User or Visitor accepts that when they click on a link or hyperlink to visit or surf a Linked Site, a window or tab may open that contains logos, announcements, pictures or other information. The User or Visitor accepts that www.tintin.com is not liable for any content that appears on Linked Sites or for any product or service referenced by the Linked Site. Linked Sites are run by operators working independently from www.tintin.com.

8.6. Moulinsart offers the possibility to have original drawings and autographs certified by the Hergé© Authentication Committee. All requests must be made in writing to the Hergé© Authentication Committee, Avenue Louise 162, B-1050 Brussels, Belgium, and the person making the request must provide their name, address and telephone number. More information can be found at www.tintin.com. The certificate of authenticity expresses an opinion based on research and on an understanding of the work of Hergé© and on the material elements at the disposable of the Hergé© Authentication Committee, without any further recourse to technical or scientific tests.

9. Behavior of the User or Visitor
The User or Visitor commits and consents to:
- Not disturb or interrupt networks connected to the Site or third-party servers;
- Conform to all rules, login procedures, and conduct required on the Internet;
- Not to try to gain unauthorized access to other IT systems;
- Not to disturb the use and functioning of the Site or of all other similar services;
- Moderate their words and messages on the Forum and to abstain from all defamatory, injurious, racist, obscene, hateful and slanderous words; www.tintin.com reserves the right to effect controls of messages and to delete them in the case of the contravention of this rule, without prejudice to the pursuit of the offending User or Visitor (see below for more detail);
- Not to cheat in a competition or use a method to obtain points in an underhand way.
- Not to create accounts for fictional participants as a way of obtaining more points and furthering one’s score.

The Forums and Chat services on www.tintin.com: The forums are areas for free expression and exchange, and all communication via the forums is governed by the Netiquette. The Netiquette is a set of social conventions that have developed and are now imposed as rules of conduct and writing on the Internet. They are based on mutual respect and on law.

Moderation: All www.tintin.com forums are moderated. Moderators may delete all contributions that do not relate with the themes of discussions, that do not abide by the editorial policy of the Site, or that contravene the law by:
- Inciting hatred and violence, notably racial;
- The justification of certain crimes, notably murder, rape, war crimes and crimes against humanity;
- Messages of a promotional or advertisement nature;
- Personal information such as telephone numbers and postal addresses must not be published, to avoid any possible harassment.
10. Cancellation and suspension

www.tintin.com may, notwithstanding its other rights resulting from the present Terms and Conditions, by written notification immediately end or suspend the service of the www.tintin.com Newsletter if the User does not adhere to all the present Terms and Conditions and if there is no reaction by the User in question to resultant communication from www.tintin.com.

11. Warning or notification
11.1. Warnings or notifications will be sent by electronic mail.

11.2. All changes of address must be notified by the party concerned to the other party.

12. Autonomy
If one of the conditions of the present Terms and Conditions is declared null and void or inapplicable, the other conditions remain valid and this condition is applicable to the extent allowed by law.

13. Renunciation
No party may be presumed to have renounced one or more of the present Terms and Conditions unless the renunciation has been communicated in writing (electronic or not).

14. Proof
The User accepts that messages by mail as well as digital files count as proof.

15. Applicable law and jurisdiction
The present Terms and Conditions are set out in accordance with Belgian law; the Brussels court retains exclusive competence in confirming all interpretations or applications of the present Terms and Conditions. In accepting the present Terms and Conditions, the User certifies that all information provided is precise and declare that they have read and accept the Terms and Conditions.
